Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by East Yorkshire Sprayers ("the Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("the Client" or "you") and East Yorkshire Sprayers, a sole trader business registered in the United Kingdom. Your use of our services indicates your acceptance of these Terms in their entirety.

2. Services Description

East Yorkshire Sprayers provides professional uPVC spraying and surface restoration services throughout the United Kingdom. Our services include, but are not limited to:

• Window spraying and restoration
• Door refinishing and transformation
• Conservatory spraying services
• Complete uPVC transformation projects
• Shop Fronts and Fascias spraying
• Soffits and Guttering services
• Color matching and consultation services
• Nationwide coverage available

3. Client Responsibilities

The Client agrees to the following responsibilities:

• Provide accurate information about your project requirements
• Ensure access to the work area during scheduled times
• Remove any obstacles that may interfere with the work
• Make payment according to agreed terms
• Report any issues or concerns promptly

4. Pricing and Payment

All quotations are provided in GBP (British Pounds Sterling) and remain valid for a period of thirty (30) days from the date of issue unless otherwise stated in writing. Payment terms shall be agreed upon in writing prior to commencement of work. Standard payment is due upon completion of services unless alternative arrangements have been documented and agreed by both parties. The Company accepts payment via bank transfer (BACS), debit cards, and cash. Where applicable, VAT will be charged at the prevailing statutory rate and included in the quoted price.

5. Cancellation and Rescheduling

The Client may cancel or reschedule scheduled services without penalty provided written notice is received at least forty-eight (48) hours prior to the agreed commencement date. Cancellations or rescheduling requests made within forty-eight (48) hours of the scheduled start time may incur a cancellation fee equivalent to twenty-five percent (25%) of the quoted price. The Company reserves the right to cancel or reschedule services due to adverse weather conditions, equipment failure, or circumstances beyond our reasonable control. In such events, the Client will be notified as soon as reasonably practicable and alternative arrangements will be offered.

6. Warranty and Guarantee

The Company provides a comprehensive ten (10) year guarantee on all workmanship and materials used in the provision of our services. This guarantee covers defects in materials and workmanship arising from normal use and proper maintenance. The guarantee is subject to the following conditions: (a) the guarantee commences from the date of completion of services; (b) it does not cover damage resulting from misuse, accidental damage, neglect, improper maintenance, or normal wear and tear; (c) any claims must be notified to the Company in writing within a reasonable time of discovery; (d) the guarantee is non-transferable and applies solely to the original Client. This guarantee is supported by our UKSA (UK Spraying Association) certification.

7. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of use, or other intangible losses, resulting from the provision or failure to provide our services. The Company's total aggregate liability for any and all claims arising out of or relating to these Terms or our services shall not exceed the total amount paid by the Client for the specific services giving rise to the claim. The Company maintains comprehensive public liability insurance in accordance with UK regulatory requirements. Nothing in these Terms shall limit or exclude our liability for death or personal injury resulting from our negligence, or for fraud or fraudulent misrepresentation.

8. Health and Safety

The Company maintains comprehensive health and safety policies and procedures in compliance with all applicable UK legislation, including but not limited to the Health and Safety at Work etc. Act 1974, the Control of Substances Hazardous to Health Regulations 2002 (COSHH), and the Construction (Design and Management) Regulations 2015. All personnel are appropriately trained in health and safety procedures relevant to their duties. The Client agrees to ensure that the work area is safe, accessible, and free from hazards prior to commencement of services. The Client must notify the Company of any specific health and safety requirements or hazards on the premises in advance. The Company reserves the right to suspend work if health and safety conditions are deemed unsatisfactory.

9. Amendments to Terms

The Company reserves the right to amend these Terms at any time in accordance with applicable UK law. Any amendments will be effective immediately upon posting on our website. Your continued use of our services following any amendments constitutes acceptance of the revised Terms. Where required by applicable law, material changes will be communicated to the Client via email or other reasonable means. It is the Client's responsibility to review these Terms periodically for any changes.

10. Dispute Resolution and Governing Law

Any disputes arising from or in connection with these Terms shall be resolved through good faith negotiation between the parties. If negotiation fails to resolve the dispute, either party may refer the matter to mediation. These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any such disputes.
